Welcome to Mazha the Plant Store. This website (the "Site") is operated by Mash the Plant Store (referred to as "we," "us," or "our"). 1. ONLINE STORE TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction. A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. LIVE PLANT DISCLAIMER & NATURAL VARIATION
  • Perishable Nature: You acknowledge that plants are live, perishable goods.
  • Natural Variation: Plants are unique living organisms. Photos on our Site represent the species, but the plant you receive will vary in shape, size, color, pattern, and leaf count.
  • Transit Stress: It is completely normal for live plants to experience temporary stress during transit. This includes minor leaf yellowing, wilting, or cosmetic spots. These imperfections do not constitute a damaged or defective product.

3. ACCLIMATIZATION & CARE RESPONSIBILITY
  • Care Period: Upon arrival, you agree to give your plant an acclimatization period of at least [e.g., 14 days] before repotting it.
  • Customer Responsibility: Once a plant is delivered, its health depends entirely on your care (watering, lighting, temperature, soil). Mash the Plant Store is not liable for plant decline or death resulting from improper care, extreme household temperatures, pests introduced post-delivery, or repotting shock.

4. WEATHER & SHIPPING RISKS
  • Weather Conditions: Live plants are highly sensitive to extreme heat and freezing temperatures. You are responsible for monitoring the weather in your local delivery area prior to ordering.
  • Winter/Summer Shipping: We highly recommend purchasing shipping insulation or heat/ice packs during extreme weather seasons.
  • Carrier Liability: Shipping dates and delivery windows are estimates provided by third-party carriers (e.g., USPS, FedEx, UPS). Masha the Plant Store is not responsible for transit delays, lost packages, damage due to carrier handling, or packages stolen after tracking shows "Delivered."

5. MODIFICATIONS TO SERVICES AND PRICES
  • We reserve the right to modify or discontinue any product, service, or plant availability at any time without notice.
  • Prices for our products are subject to change without notice.
  • We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

6. ORDER ACCURACY & CANCELLATIONS
  • We reserve the right to refuse or cancel any order you place with us. This includes, but is not limited to, orders containing pricing errors, inventory inaccuracies, or orders flagged by our system as potentially fraudulent.
  • In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail provided at the time the order was made.

7. INTELLECTUAL PROPERTY
All content on this Site, including but not limited to text, plant care guides, graphics, logos, images, and product descriptions, is the exclusive property of Mazha the Plant Store. You may not copy, reproduce, or distribute any content from this Site without our express written permission.

8. USER REVIEWS AND CONTENT
If you post plant reviews, comments, or photos on our Site or tag us on social media, you grant Mash the Plant Store a non-exclusive, royalty-free, perpetual right to use, reproduce, modify, and display that content across our marketing channels and website.

9. LIMITATION OF LIABILITY
In no case shall Mazha the Plant Store, our directors, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind—including, without limitation, lost profits, lost revenue, or property damage—arising from your use of our products. Our maximum liability to you shall not exceed the total  amount paid for the specific order in question.

10. GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.Any legal actions must be filed in the courts located within that jurisdiction.
